SERVICE VOUCHER USER AGREEMENT WITH A TRIAL PERIOD

Between Zita Services BV, having its registered office at Kanonstraat 2, box 1, 1000 Brussels, registered with the Crossroads Bank for Enterprises under number 0837.463.554 and holding recognition number 05222, represented by its director, Mr Dries VERHAEGHE (hereinafter « Zita »), and the user, the following is agreed:

Article 1: Commencement and termination

1.1
The first service provided at the user's premises shall be regarded as a trial service. Following this service, the user may terminate the cooperation with Zita by email without notice.
1.2
From the second service onwards, an agreement of indefinite duration shall commence. Any changes to the schedule requested by the user must be submitted in advance by email and shall only take effect once accepted by Zita.
1.3
Both parties shall have the right to terminate the contractual relationship unilaterally. Termination must be notified by email and shall be subject to a notice period of four weeks, during which the services shall continue to be performed. Failing this, a termination payment shall be made to Zita equal to the number of service hours during the notice period multiplied by the reimbursement value of a service voucher, being the purchase value increased by the contribution paid by the issuing company.

Article 2: Services and payment

2.1
For each hour worked, the domestic worker shall receive one service voucher from the user. Every hour worked shall, under all circumstances, be payable by the user.
2.2
In the event of non-payment or late payment by the user, default interest of 12 % shall be due automatically and without prior notice from the date of the unpaid service, together with fixed compensation amounting to 15 % of the reimbursement value of the outstanding service, with a minimum of €50.
2.3
Foreseeable changes, cancellations or absences must be notified in writing to Zita or the user at least four weeks in advance. In the event of non-compliance, the user shall compensate each hour not worked at the reimbursement value applicable to that hour. Unforeseeable changes or cancellations must be notified immediately and in writing to Zita or the user. If the user fails to inform Zita, or fails to do so in due time, an amount as provided for in Article 2.2 shall be payable.

Article 3: Rights and obligations

3.1
If, while performing the services, the domestic worker causes damage through fault to the user's household contents or home, the user must inform Zita immediately by email. Zita's liability shall in all cases be limited to the cover provided by its insurer. In assessing the extent of the damage, account shall be taken of depreciation due to age and wear and tear.
3.2
Zita shall at all times be entitled to have the services at the user's premises performed by a domestic worker other than the one usually assigned.
3.3
The user shall refrain from intimidating or discriminatory conduct. In the event of such conduct, the cooperation shall be terminated without notice.
3.4
The user may not be represented by the domestic worker or by Zita when purchasing service vouchers.
3.5
The general statutory obligations applicable to the user are as follows: (i) permitted activities include cleaning the home, including the windows, washing and ironing, minor occasional sewing work, preparing meals and running errands outside the home;(ii) examples of prohibited activities include providing personal care, carrying out renovation work, gardening, childcare, cleaning communal areas or areas used for a self-employed activity, as well as sorting laundry and selecting the programme of the washing machine or tumble dryer;(iii) only one service voucher may be received for each hour worked;(iv) no service vouchers may be handed over before the service has been performed;(v) the domestic worker may not provide services for a relative up to the second degree, a member of their household or a user who has the same place of residence.
3.6
The user shall provide the domestic worker with first-aid supplies, safe cleaning products and ergonomically appropriate cleaning equipment, including, for example: (i) a floor mop, floor squeegee and brush with an adjustable handle, as well as a mop bucket;(ii) cleaning cloths suitable for each application;(iii) safe cleaning products, excluding ammonia, bleach or products based on those substances, corrosive products, white spirit, solvents and cleaning products kept in unlabelled bottles;(iv) a stable stepladder;(v) a vacuum cleaner with attachments or extension tubes;(vi) an ironing board with adjustable height.
3.7
The user shall immediately notify Zita in writing of any change to their contact details, such as their address, email address or telephone number. If the user moves, they must inform Zita by email at least one month in advance. The contact point for users can be reached at info@zita.cleaning and 0486 91 10 97.
3.8
The user authorises Zita to process the personal data necessary for the management and performance of the agreement. The user may access their personal data through the contact point.
3.9
Zita shall notify the user in an appropriate manner of any amendments to the user agreement at least one month before they enter into force.
3.10
The user agrees to a prior visit by Zita to the service address for the purpose of organising the work.

Article 4: Other provisions

4.1
This agreement shall be governed by and interpreted in accordance with Belgian law. The courts and tribunals of Brussels shall have jurisdiction.
4.2
Zita shall provide the domestic worker with the following personal protective equipment: shoes, an apron and cleaning gloves.
4.3
The user waives the right to bring any non-contractual liability claim against Zita, its domestic workers or its directors. They shall be third-party beneficiaries of this provision.
